Terms of Service

These Terms of Service (“Terms”) govern your use of the websites, tools, and AI services operated by Barbary Group LLC, doing business as TNT AI Labs (“TNT AI Labs,” “we,” “us”), including the products marketed as LeadFlow AI Essentials™, LeadFlow AI Pro™, and the AI Growth System™ (the “Services”). By subscribing to or using the Services, you agree to these Terms.

1. The Services

We provide done-for-you AI lead-response systems for service businesses, which may include an AI website assistant, an AI phone/front-desk receptionist, missed-call text-back, automated follow-up, lead capture and qualification, appointment booking, CRM and calendar integration, review generation, and related configuration and management. The specific features available depend on the plan you select.

2. Subscriptions, Billing & Renewal

• The Services are sold as monthly subscriptions at the plan price shown at checkout ($199/mo Essentials, $399/mo Pro, $1,497/mo Growth, unless otherwise agreed). Setup fees are waived while that offer is in effect.
• Your subscription automatically renews each month and your payment method is charged on the recurring billing date until you cancel.
• Payments are processed by Stripe. By subscribing you authorize recurring charges and agree to Stripe’s terms. We do not store full card numbers.
• Prices are exclusive of any applicable taxes. We may change pricing on a going-forward basis with reasonable notice before your next renewal.
• Failed or declined payments may result in retries and, if unresolved, suspension or cancellation of the Services.

3. Onboarding & Delivery

After purchase we build and train your AI Site Assistant and/or AI Phone Assistant and deliver them for your testing and review, typically within 24–48 hours. Full deployment (including any integrations and phone-number connection) is generally completed within about 7 business days. Nothing goes live to your customers until you have reviewed and approved it. Timelines depend on your timely provision of accurate business information and access.

4. Your Responsibilities

• Provide accurate, current business information and any access we reasonably need to configure the Services.
• Use the Services in compliance with all applicable laws, including telemarketing, calling, and text-messaging rules (e.g., TCPA), consumer-protection, and privacy laws. You are responsible for obtaining any required consents from your own customers.
• You are responsible for the content, claims, pricing, and commitments your AI assistants communicate on your behalf once you approve them.

5. Cancellation & Refunds

You may cancel at any time; cancellation takes effect at the end of your current billing period. Please see our Refund & Cancellation Policy for details on how to cancel and our refund practices.

6. Acceptable Use

You agree not to use the Services to send unlawful, deceptive, harassing, or unsolicited communications; to violate third-party rights; to resell or sublicense the Services without our written consent; or to interfere with or reverse-engineer the Services.

7. Intellectual Property

We retain all rights in our software, prompts, models, configurations, and underlying technology. You retain ownership of your business content and customer data. You grant us a limited license to use that material solely to provide, operate, and improve the Services for you.

8. Third-Party Services

The Services rely on third-party providers (including, for example, Stripe for payments, AI model providers, telephony/SMS providers, and mapping/data providers). Your use may be subject to those providers’ terms, and we are not responsible for their acts or omissions.

9. Disclaimers

The Services are provided on an “as is” and “as available” basis. We do not guarantee any specific revenue, lead volume, conversion rate, or business result. Estimates, scores, and projections (including any “Revenue Leak” figures) are illustrative, not promises. AI systems can make mistakes; you are responsible for reviewing AI output before it goes live and for ongoing oversight.

10. Limitation of Liability

To the maximum extent permitted by law, TNT AI Labs will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenue. Our total aggregate liability arising out of or relating to the Services will not exceed the amounts you paid us in the three (3) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless TNT AI Labs from claims arising out of your use of the Services, your content, communications sent on your behalf, or your violation of these Terms or applicable law.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws rules. The parties will attempt to resolve disputes informally first; any unresolved dispute will be subject to the exclusive jurisdiction of the state and federal courts located in McHenry County, Illinois.

13. Changes to These Terms

We may update these Terms from time to time. Material changes take effect on the “Last updated” date above (or as otherwise stated). Your continued use after changes constitutes acceptance.

14. SMS Communications

By providing your mobile phone number and opting in to receive text messages from TNT AI Labs, you agree to receive SMS communications related to your appointments and customer service interactions.

• Message frequency may vary.
• Message and data rates may apply.
• You may opt out at any time by replying STOP to any message.
• You may receive assistance by replying HELP or contacting customer support.
• Consent to receive text messages is not a condition of purchase.
